Lessons for Mediation from the Merger of Law and Equity

A cautionary tale that focuses on the concept of "individualized justice" derived from general principles of fairness. The paper explores some connections between the contemporary institutionalization of court mediation and the historical merger of law and equity in the civil justice system, and considers what "lessons" might be learned.
